Terms & Conditions

These Terms & Conditions (“Terms”) govern participation in the Free Flags for Life™ Program (“Program”) offered by Flag Lady USA (“Company,” “we,” “us,” or “our”). By enrolling in the Program, the purchaser (“Customer,” “you,” or “your”) agrees to be bound by these Terms.

1. Program Overview

The Free Flags for Life™ Program allows the Customer to prepay for up to twenty‑five (25) American flag replacements over a twenty‑five (25) year period, subject to the terms outlined below. Number of replacements are equal to the program purchased (either 10 or 25 years).

The Program provides one (1) standard replacement flag per calendar year, in the size and material selected at the time of purchase.

2. Eligibility & Non‑Transferability

• The Program is non‑transferable.
• Benefits may only be used by the original purchaser.
• The Program may not be sold, gifted, assigned, inherited, or transferred to another individual, organization, or address.
• Any attempt to transfer or resell the Program will result in immediate termination without refund.

3. Covered Products

• Coverage applies only to standard U.S. American flags in the specific size and material selected at enrollment.
• The Program does not include:
• Custom flags
• Specialty flags
• Decorative or seasonal flags
• Flagpoles, hardware, or accessories
• Substitutions are not permitted.

4. Replacement Frequency

• The Program includes up to one (1) replacement flag per year, for a maximum of 25 total flags. Number of replacements are equal to the program purchased (either 10 or 25 years).
• Unused replacement years do not roll over or accumulate.
• Requests exceeding one replacement per year may be denied.

5. Fulfillment Process

• Customers will be notified annually when their replacement flag is available.
• Shipment occurs after the Customer confirms their current shipping address.
• Automatic shipments are not guaranteed.
• Failure to respond to fulfillment notifications may result in delayed or forfeited shipments for that year.

6. Shipping

• Standard ground shipping within the continental United States is included.
• Expedited shipping is not included.
• International shipping is not included unless explicitly stated at time of purchase.
• The Company is not responsible for delays caused by carriers, weather, or events beyond our control.

7. Address Changes

• Customers are responsible for keeping their shipping address up to date.
• Address changes must be submitted prior to annual fulfillment.
• The Company is not responsible for lost shipments due to outdated or incorrect address information.

8. Program Term

• The Program term begins on the date of purchase and expires 10-25 years from that date. (Depending on program length purchased.
• Unused replacement years at expiration have no cash value and will not be refunded.

9. Refunds & Cancellations

• All Program purchases are final and non‑refundable, except as required by law.
• Early cancellation by the Customer does not entitle the Customer to a refund or credit.

10. Modification or Termination of Program

• The Company reserves the right to modify Program procedures, provided such modifications do not materially reduce the benefits promised under these Terms.
• In the unlikely event the Company permanently ceases production of the covered flag material, any remaining unused years may be refunded on a pro‑rated basis, at the Company’s discretion.

11. Limitation of Liability

• The Company’s liability under the Program is limited to the replacement of the covered flag.
• The Company shall not be liable for indirect, incidental, or consequential damages.
• The Company does not guarantee flag lifespan, performance under extreme conditions, or protection from acts of nature.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the state in which Flag Lady USA is headquartered, without regard to conflict of law principles.

13. Acceptance of Terms

By purchasing the Free Flags for Life™ Program, you acknowledge that you have read, understood, and agreed to these Terms & Conditions in full.
